Individuals with criminal cases choose to either get a private attorney or have the court appoint them with one. Private attorneys are paid by the defendant. Court-appointed attorneys are the most common since most criminal defendants are unable to afford counsel. If a defendant is susceptible to jail time, the defendant is granted a government-paid defense counsel for representation in court.
