Official Rules for the Indigo Book Club Instagram Broadcast Channel

The Rules apply to all INDIGO BOOK CLUB broadcast channel contests sponsored by Indigo Books & Music Inc. (“Indigo”). Please review together with the online Contest Material (the “Contest Materials”) for full details. The Contest Materials are incorporated in and form part of the Rules.

1.           CONTEST PERIOD:

Contest begins and ends on the dates clearly identified in the Contest Materials (the “Contest Period”). 

2.           ELIGIBILITY:

The Contest is open to Canadian residents (the “Entrant”) of legal age of majority or older in their province of residence, at the time of entry unless otherwise advised in the Contest Materials.

The Contest is not open to Indigo’s employees, agents, representatives and prize suppliers, those with whom they are domiciled and members of their immediate families. For the purposes of these Rules, “immediate family member” means spouse, including
common law spouse, father, mother, legal guardian, son, daughter, brother and sister of the Entrant, regardless of where they reside.

3.           HOW TO ENTER:

NO PURCHASE REQUIRED.

To enter, complete the official contest entry call to action and submit (“Entry”) by following the instructions in the contest post. 

Please review the Contest Materials closely for full details.    

4.           ENTRY LIMIT:

There is a limit of one (1) Entry per person during the Contest Period. 

5.           THE PRIZES:

The number of prizes to be awarded is one (1) unless otherwise indicated in the Contest Materials. The prize description and approximate retail value will be indicated in the Contest Materials. The total approximate prize value shall not exceed $300 CAD.

Prize(s) will either be available for pick up at an Indigo retail location or be shipped via standard post at no cost to the declared winner(s) at the mailing address provided by winner(s) within sixty (60) days of being declared as a winner as disclosed within the Contest Release Form.  Prize(s) must be accepted as awarded, is not transferable and cannot be exchanged for cash. Indigo reserves the right to
substitute a prize that is, in Indigo’s sole discretion, a prize of equivalent or greater value.

6. WINNER SELECTION PROCESS:

Winner(s) will be selected in a random draw held immediately following the Contest Period end date and time from all eligible Entries received at the at the Indigo head office located at 620 King Street West, Suite 400, Toronto, Ontario M5V 1M6. Odds of winning depend on the number of eligible Entries received during the Contest Period.

7.          WINNER NOTIFICATION PROCESS:

Indigo will make a minimum of three (3) attempts to contact each selected entrant using the Instagram account handle associated with the Entry. If a selected entrant cannot be contacted either (i) online at the time of the draw; or within two (2) business days of the applicable draw date as disclosed within the Contest Material, then
he/she may, in the sole and absolute discretion of Indigo, be disqualified (and, if disqualified, will forfeit all rights to the applicable prize) and Indigo
reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted
and received to date during the Contest Period in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly
selected entrant). 

8.          WINNER CONFIRMATION PROCESS:

Before being declared A winner, each selected entrant will be required to:
(a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return (i) immediately, or (ii) within two (2) business days of notification, Indigo’s declaration and release form. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed declaration and release form within the specified time; (c) cannot accept (or is unwilling to accept) the applicable prize (as awarded) for any reason; or (d) is determined to be in violation of these Rules (all as determined by Indigo in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the applicable prize) and Indigo reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received to date during the Contest Period in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly selected entrant). 

9.           GENERAL CONDITIONS:

(a)    All Entries become the property of Indigo. This Contest is subject to all applicable laws and is void where prohibited. The decisions of Indigo with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in the Contest, each entrant agrees to be legally bound by the terms and conditions of these Rules. ANYONE DEEMED BY INDIGO TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF INDIGO AT ANY TIME. 

(b)    By entering the Contest, each entrant agrees to release, indemnify and hold harmless Indigo, its officers, directors, agents, employees, representatives, successors and assigns from and against any
injuries, losses damages, claims, actions, or any liability of any kind
resulting from such entrant’s participation in the Contest.

(c)    Indigo reserves the right, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of Indigo that interferes with the proper conduct of this Contest as contemplated by these Rules, or to adjust any of the
dates, timeframes and/or other Contest mechanics stipulated, in any way, without prior notice or obligation, in the event of any accident, digital, administrative, or other error of any kind, or as a result of any technical or
other problems, or in light of any other circumstances which, in the opinion of
Indigo, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

(d)     By entering the Contest, each entrant expressly consents to Indigo, its agents and/or representatives, storing,
sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Indigo’s privacy policy www.indigo.ca/privacy. 

(e)    NOTICE FOR RESIDENTS OF QUEBEC.  By entering the contest, you consent to the collection, storage, use and disclosure of personal information for the purpose of administering the Contest by Indigo and for the purposes described in these Official Rules, outside of Quebec, in accordance with the Indigo privacy policy found at https://www.indigo.ca/en-ca/legal/privacy-policy/

(f)      In the event of any discrepancy or
inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest Materials or other related materials, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law. In the event of any discrepancy or inconsistency between the English language version and the French language version of the official rules, the English version shall govern and control.
